Introduction & Preamble

This Privacy Policy defines the data management framework of Prop Net ("the Company" or "Daarna") for the "Daarna" platform, a comprehensive digital ecosystem dedicated to Real Estate Community and Homeowners' Association (HOA) management. The Company is fully committed to the highest standards of security and compliance in processing personal data in accordance with the Saudi Personal Data Protection Law (PDPL), the regulations of the National Cybersecurity Authority (NCA), and the Saudi Data & AI Authority (SDAIA).

This Privacy Policy is a legally binding document and an integral part of the "Terms of Use". By accessing or using the platform, you acknowledge that you have read, understood, and agreed to the terms outlined herein.

1. Key Definitions

For the purposes of this policy, the following terms shall have the meanings described below:

The Company / Daarna (Data Processor): Prop Net, the owner and technical operator of the "Daarna" platform, acting as a Cloud SaaS provider (Data Processor) processing data strictly on behalf of the HOAs.

The HOA / Union / Property Manager (Data Controller): The Homeowners' Association, Real Estate Union, or authorized Property Management firm, acting as the primary Data Controller legally responsible for determining the purposes of processing community data.

The User (Data Subject): Any natural person using the platform, including Board Members, Property Managers, Unit Owners, and Residents/Tenants.

Technical Third Parties (Sub-processors): Entities contracted by "Daarna" to operate the underlying infrastructure (e.g., Cloud Hosting, Payment Gateways, SMS Providers).

Community Service Providers (Vendors): Third parties contracted by the HOA (e.g., Maintenance Contractors, Security, Cleaning) to execute physical services on the ground.

3. Categories of Data Collected and Processed

Data necessary for community management is collected and categorized as follows:

Identity & Ownership Data (Property Registry): Full name, National ID/Iqama number, mobile number, email, occupancy status (Owner/Tenant/Proxy), and property details (Unit number, plot number, area).

Files & Sensitive Attachments: Documents uploaded by the user or Property Manager (e.g., Registered lease agreements, Title Deeds (Sak), ID copies, or photographic evidence for maintenance requests).

Operational & Community Data: Maintenance work order logs, shared facility bookings, General Assembly voting records, community polls, and community violation logs.

Financial & Invoicing Data: Community fee dues, issued invoices, and payment status. (Note: Financial transactions are processed via PCI-DSS compliant payment gateways licensed by the Saudi Central Bank; Daarna does not store any credit card or bank account data).

Technical & Tracking Data: IP addresses, Device IDs, access logs, and Cookies.

4. Sources of Data Collection

Daarna collects data not only directly from the user but also from

Direct Input: When a user registers, submits a maintenance request, or casts a vote.

HOA/Property Manager Uploads: The HOA uploads "Owner/Unit Registries" (Bulk Upload) to activate user accounts and link them to specific properties.

Automated Generation: Via platform API interactions and technical system logs.

5. Purposes of Processing & Legal Basis

Data is processed based on legal grounds (contractual necessity, legal obligation, legitimate interest, or consent) for purposes including:

Community Management: Enabling the HOA to manage the property registry, issue invoices, and collect community fees.

Field Service Coordination: Routing maintenance requests to the HOA's approved vendors and facilitating facility access.

Community Governance: Managing electronic voting in General Assemblies, ensuring the secrecy and transparency of results.

Regulatory Compliance: Retaining financial and administrative records in accordance with the Ministry of Municipal and Rural Affairs and the Zakat, Tax and Customs Authority (ZATCA).

6. Data Disclosure & Sharing (Third Parties)

Daarna never sells user data under any circumstances. Data is shared based on the "Principle of Least Privilege" with the following categories:

First: Technical Sub-processors (Daarna's Infrastructure):

Data is shared with technical operating partners (e.g., local cloud hosting providers, electronic payment gateways, and SMS notification providers) exclusively to ensure platform stability and security. They are bound by strict Data Processing Agreements (DPAs).

Second: The HOA & Property Manager (Data Controller):

Owner and resident data is made fully available to the Board and Property Manager to enable them to execute their administrative, financial, and legal duties toward the community.

Third: Community Service Providers (Contractors & Vendors):

When a contractor (e.g., a plumber or HVAC technician) is assigned a work order, the platform shares only the strictly necessary data (e.g., Owner Name, Unit Number, Mobile Number, Issue Description) to allow them to access and execute the work.

Fourth: Government & Judicial Authorities:

In response to official, legally binding requests from competent security, judicial, or regulatory authorities in the KSA.

Legal Disclaimer (Protection of Daarna ):

Daarna disclaims any legal liability for any misuse of data, privacy breaches, or administrative decisions made by the "HOA", "Property Manager", or "Service Providers" using the data accessible to them via the platform. Those entities (as Data Controllers or Beneficiaries) bear direct responsibility toward the users in accordance with the PDPL.

7. Data Retention & Statutory Periods

Operational Data: Retained as long as the HOA maintains an active subscription with Daarna .

Financial Records & Invoices: Daarna  is legally obligated to retain financial records, invoices, and community fee payment logs for a minimum period of (10 Years) in strict compliance with KSA tax and commercial regulations.

Upon contract termination, a full database export is provided to the Property Manager. Thereafter, copies are securely deleted from Daarna 's servers, excluding statutory financial records and security audit logs.

8. Cross-Border Data Transfer

Daarna is committed to storing and processing user data on local servers within the Kingdom of Saudi Arabia. In the event that technical necessity requires the use of cloud services or technical support outside the KSA, the Company commits to implementing all necessary technical and legal safeguards to ensure the protection level is not lower than that stipulated in the PDPL and its Cross-Border Transfer Regulations.

9. Data Security & Breach Response

Daarna implements advanced security standards (e.g., encryption at rest and in transit, firewalls, strict access controls). In the event of a Personal Data Breach that is likely to result in a high risk to users, Daarna  is legally bound to notify the Competent Authority (SDAIA/NDMO) within a maximum of (72 hours), and to inform the HOA (Data Controller) and affected users without undue delay to enable precautionary measures.

10. Data Subject Rights

Users have the right to exercise their rights guaranteed by law, which include:

Right to Access & Know: To know what data is stored and for what purpose.

Right to Rectification: To update inaccurate or incomplete data.

Right to Erasure: To request deletion of data when the purpose of processing has expired.

Right to Withdraw Consent: To withdraw consent at any time (without affecting the lawfulness of prior processing).

Right to Restrict Processing: In cases specified by law.

Automated Decision-Making: The right not to be subject to decisions made solely by automated means that produce significant legal effects.

Request Routing Mechanism: Because "Daarna" is the technical platform, and the HOA/Property Manager controls the community registry, users are requested to direct their data rights requests (such as deletion or correction) directly to the HOA or Property Manager of their community. Daarna commits to providing the technical tools (e.g., Admin Dashboards) for the HOA to execute these requests immediately, and to providing necessary technical support to ensure regulatory compliance.

Right to Lodge a Complaint: Users have the right to lodge a complaint with the Competent Authority (Saudi Data & AI Authority - SDAIA) if their statutory rights are not respected.

11. Minors & Cookies

Minors: The platform is designed for real estate management, financial transactions, and legal contracts; it is not intended for individuals under the age of (18).

Cookies: The platform uses cookies to enhance performance and manage login sessions. Users can disable them via browser settings, though this may affect platform functionality.

12. Updates, Governing Law, and Contact

Amendments: Daarna  reserves the right to update this policy to keep pace with any amendments to the PDPL. The "Last Updated" date at the top of the document serves as notice.

Governing Law: This policy is governed by the laws of the Kingdom of Saudi Arabia, and the exclusive jurisdiction lies with its competent courts.
